Do You Need a Broker?

Not every purchase requires a broker, but their value increases with:

Transaction size — On a £200,000+ vessel, the broker's expertise in handling escrow, title, and documentation is worth far more than their fee saves.
Complexity — Foreign-flagged vessels, boats with existing finance, or unusual ownership structures benefit enormously from broker expertise.
Your experience — First-time buyers benefit greatly from broker guidance at every step.
Geography — If the boat is in another country or region, a local broker's knowledge of local regulations, yards, and surveyors is invaluable.

For smaller, simpler transactions (a 20-foot day-sailer, for example), buying privately is quite manageable.

Choosing the Right Broker

Accreditation

Look for brokers who hold professional accreditation from recognised industry bodies:

BMF — British Marine Federation (member brokers)

Specialisation

Choose a broker who specialises in the type and size of vessel you are buying or selling. A broker who primarily handles powerboats under 30 feet may not be the best choice for a 50-foot offshore cruising ketch. Ask about their recent sales in your category.

Local Knowledge

A broker based in the port where the boat is located will have better access to local surveyors, yards, and the local buyer market. For international searches, a broker with an established network in the relevant region is valuable.

Understanding Broker Agreements

Exclusive Listing Agreement (for Sellers)

Most brokers will ask for an exclusive listing agreement — a contract that gives them the sole right to market your boat for a defined period (usually 6–12 months). In return, they invest in marketing and advertising. If you sell privately during the exclusive period to a buyer introduced through the broker's marketing, you will still owe the commission.

Read the agreement carefully, particularly the definitions of "introduced buyer" and the exclusivity period. A reputable broker will not object to you reviewing it with a solicitor before signing.

Open Listing (for Sellers)

Some sellers prefer an open listing, where multiple brokers can market the boat and only the broker who achieves the sale earns the commission. This gives more marketing exposure but reduces each broker's incentive to invest heavily in your listing, as they may do the work only for another broker to find the buyer.

How the Escrow Process Works

When a buyer makes an offer and it is accepted, a deposit (typically 10% of the purchase price) is paid into the broker's escrow (client) account. This is held separately from the broker's own funds and is only released in specific circumstances:

To the seller — at successful closing, as part of the purchase price
To the buyer — if the vessel fails survey or sea trial and the buyer withdraws under the terms of the PSA
To the seller — if the buyer withdraws without cause (i.e., no survey failure), the deposit is typically forfeited

Always verify that a broker holds their escrow funds in a segregated client account with a recognised bank. A reputable broker will provide proof of this on request. Mishandling of escrow funds is the most serious form of broker misconduct.

Working with the Listing Broker as a Buyer

When you enquire about a boat listed by a broker, remember that broker's primary duty is to the seller. That does not mean they are adversarial toward you — a good broker facilitates a fair deal for both parties — but they will advocate for the seller's interests in negotiation.

You can:

Ask the listing broker to represent you (dual agency) — they will try to be neutral, but their commercial incentive is to close the deal.
Engage your own buyer's broker who will represent only you — useful on high-value purchases.
Deal with the listing broker directly but be aware of the dynamic.

A listing broker cannot legally misrepresent the vessel to you. Any known defects must be disclosed. If you discover that a broker withheld material information that affected your decision to purchase, you may have recourse through their professional body or the courts.

Red Flags to Watch For

A broker who pressures you to make a quick decision without adequate inspection time.
Reluctance to provide the survey report or disclosure of known issues.
Escrow funds not held in a segregated client account.
No written listing agreement or commission terms.
Inability to provide references or proof of professional accreditation.
Descriptions that are materially different from the actual condition of the boat on viewing.
