Understanding a Boat's Documentation and Registration

A boat's documentation and registration are its legal identity. For buyers, these records establish proof of ownership and reveal any outstanding finance. For sellers, clean paperwork enables a smooth, legally sound transfer. For cruisers crossing borders, the right registration opens harbours and satisfies customs officials. This guide explains the key documentation systems in the UK, USA, and internationally, and what every buyer or seller needs to understand before completing a transaction.

Why Registration and Documentation Matter

Registration does far more than put a name on a hull. It creates a verifiable chain of title that protects buyers from purchasing a vessel with undisclosed liens or disputed ownership. It also:

Establishes legal identity — A registered vessel has a unique name, official number, and flag state, allowing port authorities and coastguards to identify her instantly.
Enables mortgage security — Lenders can register a charge against a documented vessel, making marine mortgages and financing possible.
Facilitates international cruising — Many countries require a Certificate of Registry as proof of nationality before granting clearance.
Protects against theft — Registration links a vessel to a verified owner, discouraging theft and aiding recovery.

The Hull Identification Number (HIN / CIN)

Before examining any registration documents, locate the Hull Identification Number (HIN in North America; CIN — Construction Identification Number — in the EU). This is the boat's permanent physical identifier, equivalent to a vehicle's VIN.

Where to Find the HIN

On the starboard (right) side of the transom, at or near the top, for boats built after 1972 in the USA.
EU-built vessels carry the CIN on the starboard transom or, if no transom, on the starboard hull aft.
A secondary duplicate HIN is typically hidden inside the hull — under a fitting, beneath a seat, or inside a locker — to aid identification if the primary plate is tampered with.

What the HIN Tells You

A standard HIN encodes the manufacturer's identification code (MIC), the hull serial number, and the model year. Verifying that the HIN on the hull matches the HIN on all registration and build certificates is an essential fraud-prevention step. UK Registration Options

Ship registration in the United Kingdom is administered by the UK Ship Register (UKSR), an executive agency of the Maritime and Coastguard Agency (MCA). There are two relevant parts of the register for pleasure vessels.

Part I — Full Registration

Part I registration is the gold standard for UK-flagged vessels. It is required for vessels used commercially, for any vessel over 24 metres, and for any vessel against which a mortgage is to be registered. It is also the registration type recognised internationally for cruising passports and Letters of Consent.

The vessel receives a unique Official Number (ON) and a Certificate of British Registry.
Ownership and mortgage history are recorded on a searchable public register, allowing buyers to verify title and check for outstanding charges.
The vessel's name must be approved and is protected on the register.
Renewal is every five years; the registered owner must be a British national, UK resident, or a UK-registered company (post-Brexit rules apply for EU residents using the UK flag).

Part III — The Small Ships Register (SSR)

The Small Ships Register is a simpler, cheaper option for recreational vessels under 24 metres owned by UK nationals. It is widely used for yachts and motorboats used solely within UK and near-European waters.

Provides a registration number and certificate sufficient for most EU and Mediterranean authorities.
Does not record ownership history or support mortgage registration — it is proof of nationality, not proof of title.
Registration lasts five years and is renewable online at low cost.
For buyers: an SSR certificate alone does not confirm the seller owns the vessel free of finance. Always conduct a separate title search.

Which to Choose

If you are taking out a marine mortgage, plan to cruise offshore, or want a publicly searchable ownership record, choose Part I. If you are a private owner keeping the boat in coastal waters and financing is not involved, Part III is sufficient and simpler to maintain.

US Registration: USCG Documentation vs State Registration

In the United States, vessel registration operates at two levels: federal documentation administered by the US Coast Guard, and state registration managed by each individual state.

USCG Documentation

Federal documentation through the US Coast Guard National Vessel Documentation Center (NVDC) is available for vessels of five net tons or more that are wholly owned by US citizens. It is required for vessels used in coastwise trade, fishing, or dredging in US waters.

A documented vessel receives a unique USCG Official Number, which must be permanently marked on the interior of the hull.
The Certificate of Documentation (COD) is renewed annually and serves as proof of US nationality for international travel.
Preferred Ship's Mortgages can be recorded against documented vessels, making marine lending more straightforward.
Ownership history and any recorded liens are publicly searchable via the NVDC database.

State Registration

Vessels that do not qualify for or elect not to use federal documentation must be registered in the state where they are principally used. State registration:

Is mandatory for most motorised vessels and, in many states, for sailboats above a certain length.
Issues a state registration number displayed on the hull (e.g. "FL 1234 AB").
Does not provide a federal nationality document for international cruising.
Lien searches must be conducted individually through the state's UCC filings and title records — there is no single national database equivalent to the USCG system.

A vessel can hold both state registration and USCG documentation simultaneously, though this is uncommon outside of commercial operations. For buyers financing through a US lender, USCG documentation is almost always required.

EU and International Flagging Options

For vessels cruising European waters or purchased by non-UK/US nationals, several flagging options exist. Common choices include registering under a flag state such as France, Germany, the Netherlands, or Malta (popular for tax and administrative reasons). The EU does not operate a single EU-wide register; each member state maintains its own national register with differing requirements for residency, vessel size, and inspection.

For long-distance offshore cruisers, the flag state determines which consular services are available to the vessel and crew, which safety standards apply, and which ports grant entry without difficulty. Well-recognised flags such as the UK (Red Ensign), France, and the Netherlands are accepted universally. Flags of convenience — states that register vessels with minimal oversight — can attract scrutiny in some ports and should be approached carefully.

VAT Status: Paid, Unpaid, and Evidence

Within the European Union, Value Added Tax on pleasure vessels is a significant commercial issue. A vessel on which VAT has been properly paid and documented can move freely between EU member states without further liability. A vessel with uncertain or unpaid VAT status creates serious risk for the buyer.

What VAT Status Means

VAT paid — VAT was paid on the vessel when it was first supplied new within the EU, or upon importation. This is evidenced by the original purchase invoice showing VAT paid, or a customs import entry (C88/E2 in the UK, or national equivalent in the EU).
VAT unpaid — The vessel has never had EU VAT paid on it (e.g. it was built in the USA and imported without paying import VAT, or it has always been kept outside the EU). Such a vessel may be subject to VAT and import duty before it can legally be used in EU waters.
Uncertain VAT status — Documents have been lost, the vessel has changed flags multiple times, or the chain of evidence is broken. This is a red flag requiring professional advice before purchase.

Documentary Evidence Required

Original purchase invoice or builder's invoice showing VAT amount and rate.
Customs import entry if the vessel was imported from outside the EU/UK.
Continuous chain of ownership linking VAT-paid evidence to the current seller.

Post-Brexit, a vessel that was in UK waters on 31 December 2020 retains its UK VAT-paid status but is no longer automatically treated as EU VAT-paid. Vessels moving between UK and EU waters may need to establish VAT status separately in each jurisdiction. Always take advice from a specialist marine tax adviser if VAT status is unclear.

Title and Liens: Checking for Outstanding Finance

One of the most important pre-purchase checks is confirming that the seller genuinely owns the vessel free of any outstanding loans or charges. A buyer who purchases a vessel without checking for liens may inherit the debt — or worse, lose the vessel to a creditor.

How to Search for Liens

UK Part I vessels — Search the UK Ship Register directly; mortgages are recorded against the Official Number.
USCG documented vessels — Search the NVDC for recorded Preferred Ship's Mortgages.
UK SSR and state-registered US vessels — No centralised lien registry exists. In the UK, use the HPI maritime check or engage a specialist maritime solicitor. In the US, conduct UCC lien searches in the state of documented residence of the seller.
EU vessels — Requirements vary by flag state. A maritime lawyer in the flag state can conduct appropriate searches.

Documents That Should Transfer at Sale

A complete sale should include the transfer or provision of the following documents. Insist on receiving all that apply before final payment is made:

Bill of Sale — A signed document confirming the transfer of ownership, the agreed price, the date of sale, and the vessel's details including HIN and official number. This is the primary proof of purchase.
Registration Certificate — The current certificate of registry (Part I, SSR, COD, or national equivalent). Some registries require formal transfer of registration; others simply require the new owner to re-register using the bill of sale.
VAT Evidence — All original invoices, import documentation, and any previous bills of sale that establish the chain of VAT-paid status.
Deletion Certificate — If the vessel is being re-flagged (changing from one national registry to another), the current flag state must issue a deletion certificate or closure certificate confirming the vessel has been removed from their register. Most flag states will not register a vessel that is already registered elsewhere.
Builder's Certificate — For newer or high-value vessels, this confirms the manufacturer's details, build date, HIN, and original specification. It supports VAT evidence and is important for insurance purposes.
CE Declaration of Conformity — Required for EU/UK-built recreational craft, confirming the vessel meets the Recreational Craft Directive (or its UK equivalent, the Recreational Craft Regulations). Absence of this document can cause problems with insurance and sale in Europe.
Survey reports — Not a registration document, but any existing survey reports should transfer with the vessel for information purposes.

MMSI Registration

An MMSI (Maritime Mobile Service Identity) number is a nine-digit number used by VHF DSC radios, AIS transponders, and EPIRBs to identify a vessel in distress or routine communications. It is not a registration document in the ownership sense, but it is critically important for safety and must be correctly managed at the point of sale.

The MMSI is registered to a specific vessel and owner. When a vessel changes hands, the new owner must re-register the MMSI in their own name with the relevant authority (Ofcom in the UK; the FCC in the USA; national telecoms authorities elsewhere).
Using an MMSI registered to a previous owner creates a safety risk: if a distress call is transmitted, rescue services will receive the previous owner's details and may be unable to contact anyone.
In the UK, ship radio licences (which include the MMSI) are obtained via Ofcom. The licence transfers with the vessel but must be updated to reflect the new owner's details promptly after sale.
An EPIRB (Emergency Position Indicating Radio Beacon) must be separately registered with the national authority (in the UK, the MCA EPIRB registry; in the US, NOAA). Ensure the EPIRB registration is updated to the new owner's contact details immediately after purchase.

Common Documentation Problems and How to Resolve Them

Lost or Missing Title Documents

If a Part I or USCG-documented vessel has lost its certificate, duplicate certificates can usually be obtained from the registry on application with supporting evidence of ownership. For SSR-registered vessels, the online register can be searched and a new certificate issued. For vessels with no traceable registration history, a maritime solicitor can help establish title through statutory declarations and other evidence. This process takes time — factor it into your completion timeline.

Uncertain VAT Status

If the original VAT invoice has been lost but the vessel was demonstrably in EU/UK waters before a certain date, HMRC (UK) and equivalent EU tax authorities may accept alternative evidence such as marina berthing records, insurance records, or surveys showing dates. A specialist marine tax adviser should be engaged. In some cases, VAT may need to be paid (or re-paid) as part of the purchase; this cost should be negotiated into the price. Refusing to purchase a vessel with genuinely unresolvable VAT status is a legitimate decision.

Disputed Ownership

Ownership disputes most commonly arise from informal transfers (handshake deals without proper bills of sale), estates and probate situations, vessel seizure by a creditor, or fraud. Part I and USCG documentation are valuable here because the register provides a clear ownership record. Disputes involving undocumented or SSR-registered vessels are harder to resolve and typically require solicitor involvement. Never proceed with a purchase if ownership is disputed — wait until the matter is fully resolved and reflected in the register.

Outstanding Mortgage or Finance

If a lien search reveals an outstanding charge, the seller must discharge it before or simultaneously with the sale. The standard mechanism is to use part of the sale proceeds to pay off the lender directly, with the lender releasing the mortgage upon receipt of funds and confirming deletion from the register. A solicitor or escrow arrangement protects both parties in this scenario.

Putting It All Together

Documentation due diligence is not optional. It protects your investment, enables your financing, and ensures that the vessel you are buying is genuinely the seller's to sell. Whether you are looking at a small motorboat on the SSR or a blue-water cruiser with a Part I certificate and a USCG endorsement, the principles are the same: verify the HIN, confirm the registration, check for liens, establish VAT status, and insist on a complete document pack at completion.
